WSOC has learned that Jackson Musyoka, of Flower Mound, Texas, is the driver who was trapped for nearly four hours inside his tractor-trailer Thursday on Interstate 85. (READ: [VIDEO] Kenyan driver from Dallas pulled from overturned truck after 4 hours in North Carolina)
Firefighters and rescuers worked in the heat and in poison oak for hours to save Musyoka, who officials said lost his leg in the crash.
They feared he would die, but reassured him the whole time that he would be OK.
WSOC learned Musyoka’s wife was on the phone with him when the crash happened.
“That was the worst ever, just to hear all of that,” Tyshell Musyoka said, adding that her husband looked down for a brief moment while driving and when he looked back up the truck was swerving.

“I heard the tumbling and everything.  Then it got silent for a minute and then that’s when I started hearing him screaming for help,” she said.
He had no idea his wife was still on the phone, listening and worrying, until rescuers arrived. His wife heard their voices.
“The way they were doing him it pretty much eased my mind,” she said.
Tyshell Musyoka couldn’t hear everything, but she heard rescuers asking for room just as they got him free.  Jackson Musyoka’s cell phone battery died before they took him out. She didn’t get to hear them taking him up to a waiting helicopter.
“I just want to say, Thank you so much,'” Tyshell Musyoka said.
Tyshell Musyoka said her husband is weak, but in good spirits.
Police are still not sure what caused the 18-wheeler to go off the interstate.
Fireman shares his rescue story
Fireman Alex Hardee worked side-by-side with other rescuers.
“Four hours for me. That’s a first,”  Hardee said. “That’s the longest that I have probably been a part of,” Hardee said.
Authorities said the trucker’s leg was so badly damaged, paramedics considered amputating it on the scene.
Hardee climbed into the rig in full turnout gear on a blistering hot day.
“Your body temperature, no matter how much you sweat, you can’t drink enough water,” Hardee said.
Fire crews took turns so that they didn’t overheat, going up and down a steep hill.
Cables from a large wrecker kept the truck from sliding further down hill.
“We have a job to do. We signed up to do this. We trained for this,” Hardee said, adding for four hours firefighters and police focused on the trucker trapped inside.
“Keeping him abreast of the steps were taking to extricate him. Just more or less talking to him and keeping him calm,” he said.
They had to remove the floor of the rig to pull him out. Hardee helped to take him back up the hill to a waiting medical helicopter.
“We were excited. We were glad that he was out. Then we got right back into the mode of, ‘We got to get him out of here,’” Hardee said.
They saved his life, but the damage to his leg was too severe. Doctors at the hospital amputated his leg. One officer said it’s still a success and that in 29 years he has never had rescue last so long and have the patient survive.

Divorce in Kenya is now a costly affair as courts award huge payouts

Divorce has become an expensive affair, particularly for the rich, with courts handing out hefty payouts.
Recently, a man was ordered to pay Sh30 million to his ex-wife within 90 days after the court dissolved their 22-year marriage.
Justice Luka Kimaru also directed Peter to provide Njoki with a house within either Runda, Lavington, Kileleshwa, Kilimani or Karen or any other upmarket area of Nairobi that would accord with the standard of living that she was used to during their marriage.
“The respondent (Peter) shall provide the house within 90 days of the date of this judgment or if he fails to do so, he shall pay to the petitioner the sum of Sh60 million,” ruled the judge.
Another Mombasa-based tycoon was last December directed to pay a woman Sh10 million after the court found she had been lured from India into marriage in Kenya on a false pretence.
“I find that this act of deception by the man was cruel in the extreme. It condemned the innocent woman to a life devoid of sexual intimacy and devoid of children, which is the desire of any woman in a marriage,” ruled Justice Maureen Odero.
But one of the most expensive settlements involving Sh1 billion was of a Tanzanian tycoon and was settled in Mombasa in 2011.
The businessman, MB, divorced his wife of four years, NA, five years ago in Mombasa after he accused her of misusing Sh452 million he used to send to her to bank in the family account.
The couple divorced at the Kadhi’s court in Mombasa on June 19, 2006, after MB accused her of swindling him the money while he was on a business trip abroad.
The two shared equally property and money equivalent to a billion shillings in a final settlement in late 2011.
MB, who is a native of Zanzibar, has interests in food, transport and real estate in Kenya, Uganda and other African countries.
These cases highlight the outcome of nasty divorce proceedings, often conducted away from the public to protect children.
It is all thanks to the Constitution, which has made it easier for women seeking property from their husbands during or after divorce.
Despite one’s current financial status, Article 45 gives partners equal rights “at the time of the marriage, during the marriage and at the dissolution of the marriage”.
Further, Article 68 of the Constitution provides that Parliament shall enact legislation to “regulate the recognition and protection of matrimonial property and in particular the matrimonial home during and on the termination of marriage.”
A review of recent divorce cases highlights causes of conflict, including unfaithfulness, cruelty, denial of conjugal rights and financial strain.
The marriage of CJ, 29, and RW, 27, was dissolved in June, last year, after the court upheld the woman’s assertion that her husband was a tribalist and cruel.
Another couple in Nyeri with a chain of chemists will settle their divorce case in the Supreme Court.
In Kisumu, a magistrate’s court ruled that the marriage between VA and EN, a university professor had irretrievably broken down. Cruelty and unfaithfulness featured in the case.

Impotent Kenyan Man to Pay Wife Sh10 Million for Trapping Her in Sexless Marriage

A Mombasa-based businessman was slapped with a Sh10 million fine for luring a woman into a sexless marriage. The marriage carried on for 18 years.
Patel and Sonia were married in 1995 at the Arya Samaj, Vithalbhai Patel Road, Kakad Wadi, Bombay, India according to Indian marriage customs.
Justice Maureen Odero in December last year directed Patel to either pay Sonia a lump sum of Sh10 million, or Sh4.25 million in instalments within 60 days.
Justice Odero described the monthly sum of Sh4, 000 that Patel offered Sonia as a pittance, given that the minimum wage in the country currently is now Sh7, 000.
HUSBAND’S IMPOTENCE
Odero noted that Sonia was lured into the marriage on false pretense, and was brought into a foreign country only to be turned into a house help.
“I find that this act of deception by the man was cruel in the extreme. It condemned the innocent woman to a life devoid of sexual intimacy and children which is the desire of any woman in a marriage,” Odero ruled.
The court heard that the couple met and got married in India in March 1995. After their marriage, the couple came back to Mombasa where they cohabited as man and wife for 18 years.
They lived in the family home in Nyali, which at first was a rented abode, before the year 1998 when Patel’s father purchased the spacious four-bedroom apartment they currently live in.
Sonia told the court she was from a family of humble means and was raised by a single mother. She said she had told her husband during courtship and his family that her family could not afford a lavish wedding. Nor could they afford to pay a dowry as Hindu custom dictates.
By all accounts their marriage was peaceful despite the fact that due to Patel’s impotence the couple never engaged in sexual relations at all in their 18-year marriage. As a result they bore no child. They tried fertility treatments in India and the United Kingdom which never worked.
Sonia told the court in her evidence that because divorce was a taboo in the Hindu community she opted to persevere in the union.
However, after both Patel’s parents died in 2006, Patel turned cruel, belligerent and uncaring. She said he even tried making her return to India.  In 2009, he finally filed for divorce.
Patel on his part claimed his wife told people that he was impotent and was unable to perform sexually, which embarrassed him. Sonia countered, saying Patel should have informed her of his impotence before the marriage.
In awarding the Sh10 million fine, the judge said the court made a finding that she had no employment or indeed any definite means of support at the moment and directed Patel to meet the costs of the suit.
